Will Requirements Different Countries

  My mother is currently in the middle of planning to move abroad (to turkey) we were wondering if a uk will, will be valid in turkey or will she have to have a further will drafted in turkey, or is there a special international will?

No, a Will drawn up in the UK will not be able to deal with any assets she has in Turkey. She would be advised to make one for her UK assets and one for her Turkish assets.

    My uncle lives in barbados and has asked me to get a will drawn up for him. He has written down and signed his request. How do i go about getting a legal will drawn up?


I assume that your Uncle has assets in this country which is why he has asked for your assistance. If you are intending to instruct a Solicitor to act on your behalf the Solicitor will require instructions from your Uncle direct. Instructions could be communicated via e-mail or post as appropriate. The Will will need to be signed in accordance with the Law of England & Wales so care is required.

    Me and my partner are both South African and have been living in the UK for 4 years. We are currently here on a work permit. We bought a house in 2001. We do not have any assets in South Africa, apart from a bit of money in a bank account. Do we need seperate wills for our estate in UK and money in SA? We are not domiciled here so how does it affect our will?


I would suggest that Wills are made in each country. Please be careful however not to revoke the first Will when making the second.

    I am a UK resident with a Will in place. I have recently acquired a property in Spain and wish my Will to be valid in Spain as well as UK. I understand there is a Will called a Universal Will for this purpose. Can you advise me further, please?


I recommend that you have a further Will in Spain to deal with your Spanish Estate. When your Spanish Will is drafted reference must be made to your exsisting Will in this country.

A single Will can be drafted incorporating all your estate if you wish but I personally prefer separate Wills for each Country.

I recently read a book about 'How easy is to make a will!!' However it referred to the Law in England & Wales.

Is NI Legislation any different when it comes to drafting a Will??


No the rules are the same throughout the UK. The only thing that will be different is the tax regime and possibly some inheritance rules in cases where the will is contested, apart from that your will is your testement and valid in most western countries.

    I am a British citizen presently working overseas in Thailand, also my wife is Thai. We have property and assets in Thailand, however this is predominantly held in my wife's name due to local restrictions on ownership of land by foreigners. I also own two properties in the UK and hold some offshore and UK based investments. The nature of my employment may mean I would be relocating to other work locations throughout the world, and potentially may only return to the UK for visits.

I am very interested in your will making service and kindly request some advice regarding my circumstances, since your website indicated that your service also would cover overseas residents such as myself. Also whether a mirror will could be prepared for my wife, although I presume as her assets cannot be legally transferred and are held in another country this may not be possible.

Therefore, I would be most grateful if you could give me some advice in this matter.


The will expresses that the courts of England and Wales will have jurisdiction over any disputes, so the division of assets would have to take place in accordance with English law regardless of where you live now or in the future.

You would have to buy a Pac each, but they can mirror each other exactly as you require.

    My husband and I would like to make a will through your company. As we live in Northern Ireland, would this type of will be valid.


A Will drafted in England & Wales will be valid in Northern Ireland.

    I live in scotland - would the wills that you can produce through this on-line service be suitable under scottish law as I am aware that things are different up here. or would I be better to go to a solicitor up here ? thanks.


The Will is valid in the whole of the UK, only the rules about intestacy may be different or Inheritance Act claims.
